  • General Conditions

    1. THE PROGRAMME: INTRODUCTION

    These terms and conditions govern the REWARDS PROGRAMME OF SILKEN HOTELS.

    The REWARDS PROGRAMME OF SILKEN HOTELS, S.A. with registered address at Avenida Zabalgana, 1 - 01015 Vitoria (Álava), and Tax ID No. A-60850500.

    These terms and conditions detail the process of earning points for programme members. By expressly accepting or, if applicable, accepting without the need for a conventional signature of said terms and conditions (with prior effective knowledge of their existence and content), the member declares to be aware of the content thereof and to be subject to them as long as their status as a programme member continues.

    The member can only enjoy the benefits inherent to the programme at those establishments and for the services and rates that are currently included in the programme.

    SILKEN reserves the right to unilaterally modify these terms and conditions, as well as to modify the list of establishments, services and special conditions included in the programme. The member will at all times have access to the up-to-date and valid general terms and conditions, either by consulting the SILKEN website, through the Loyalty Department or through other means of information.

    2. PARTICIPATION IN THE PROGRAMME

    Enrolment in the programme is free.

    The means to request enrolment in the programme and enjoy the associated benefits are as follows:

    ·         Via the internet, by completing the form available at www.hoteles-silken.com

    Persons who become programme members will have a unique personal account and virtual card that accredits them as programme members. The card is personal and non-transferable, and it will identify the member with their details and personal points card number, enabling them to participate in the programme as soon as they have accepted these general terms and conditions.

     

    3. SILKEN REWARDS CATEGORIES

    Each customer has a personal and non-transferable account number that identifies them with their personal information, enabling them to participate in the programme. Customers can access this information through their virtual card. SILKEN reserves the right not to issue physical cards.

    There are 3 categories in the programme awarded based on the stays the member accumulates over a period of 24 months.

    The criteria for reaching or remaining on the programme levels are as follows:

    • SILVER Membership: Basic level of the programme for new members.
    • GOLD Membership: Assigned to members who have earned 20,000 points.
    • SILK Membership: Assigned to members who have earned 75,000 points.

    The different membership categories are awarded or modified directly by SILKEN based on the above criteria, which may be reviewed or modified at SILKEN’s discretion at any time, with prior communication to the members.

    The benefits of the SILKEN REWARDS programme are only granted to natural persons who personally enjoy any benefits of their membership. Legal entities cannot register in the programme or accumulate any type of benefit.

    Biannually from the date of enrolment in the programme, a general review process of the programme categories will be carried out. If a category change is applicable, the benefits associated with the new category will take effect from the moment the categorisation becomes effective.

    Each category entitles members to specific benefits, which will be described in section 8.

    4. POINTS

    The currency of the programme is the point.

    Points cannot be exchanged for money or other goods outside the specified programme benefits.

    • Earning Points

    Points are earned personally by the member.

    Points accumulate without a value limit based on bookings made on the SILKEN HOTELS website.

    • Points Expiry

    If there is 24 months of inactivity on Silken, the member’s status will revert to the previous level.

    5. SILKEN HOTELS WEBSITE

    Once the user registers as a programme member, they can access their account by correctly logging in.

    Through the account, the programme member can check their virtual card, points balance, view detailed information on recent point accumulations, update their personal details, learn about the programme and perform other operations made available by SILKEN.

    SILKEN is not responsible for any unauthorised access to the member’s account by a third party or for any fraudulent use of data or information by the member.

    6. ACCOUNT HOLDERS

    To become a programme member, individuals must complete and sign the registration form on the SILKEN HOTELS website.

    Cardholders must be natural persons over 18 years of age.

    Acquisition of programme membership is subject to acceptance of these terms and conditions. Programme members receive a unique personal account and a virtual card that accredits them as programme participants, enabling them to take advantage of the various programme benefits.

    7. PURPOSE AND BENEFITS OF THE PROGRAMME

    The programme’s purpose is to reward guests of Silken Hotels. For this, members receive a virtual card where they accumulate points for bookings made through the SILKEN HOTELS website.

    Points are earned for:

    • Each effective stay, meaning bookings fully paid at a Silken Hotel.
    • Contracting services through the website.

    Points will not be accumulated in the following situations:

    • If the invoice is not fully paid.
    • For bookings made through intermediaries.
    • For bookings with negotiated rates.
    • For bookings with promotional codes.
    • For bookings with travel agent rates.
    • In case of a no-show.

    By marking the corresponding box in the data collection form, the member also authorises the receipt of commercial communications (newsletters, offers, promotions, news, etc.) by email regarding the chain and its different establishments.

    Finally, we hereby inform you that at any time you may exercise the rights recognised by the Law, in particular, the rights of access, rectification, cancellation and opposition, by writing to the address indicated above or by sending an email to lopd@hoteles-silken.com attaching the request and a copy of your ID.

    8. REWARDS BY CATEGORY

    Each membership level offers a range of associated benefits or advantages.

    9. CANCELLING PROGRAMME MEMBERSHIP

    Participation in the programme may be cancelled for any of the following reasons:

    A) At the Member’s Request:

    At any time, the member may choose to unsubscribe from the programme. To do so, the member must communicate their request in writing through the programme’s website. This voluntary cancellation will result in the automatic loss of all points and benefits as soon as the member’s card becomes inactive, and their status as a programme member is revoked.

    B) At SILKEN’s Request:

    SILKEN reserves the right to temporarily suspend or permanently terminate any programme member in the following cases:

    - If the member has not utilised SILKEN’s products and services within a period of 36 months and/or has not engaged in any point-earning transactions through billing.

    - If there has been improper or fraudulent use of the programme: Non-compliance with the terms and conditions, irregular payment or inappropriate conduct at the hotel, without prejudice to any claims for damages that SILKEN may make, if applicable.

    - In the event of the member’s death or disappearance.

     

    10. PROTECTION OF PERSONAL DATA

    In accordance with the provisions of Article 5 of Organic Law 15/1999 on the Protection of Personal Data (LOPD) and Article 12 of RD 1720/2007, approving the Regulation for the Implementation of the LOPD, we hereby inform you that the data provided and any data subsequently provided and generated during your participation in the Silken chain’s Loyalty Programme will be incorporated into a file under the responsibility of the entity in charge of its management, HOTELES SILKEN, S.A., with registered address at Avda. Zabalgana No. 1 Oficina 4, 01015 Vitoria (Álava). The purpose of this data processing is to enable the optimal functioning of the aforementioned programme and its benefits, including sending communications about offers, promotions, news, etc., specifically directed to programme members. The proper functioning of the programme necessarily requires the sharing of certain personal data with different owners of establishments within the chain.
